This section outlines a unified procedure for handling all complaints submitted to the Seller. It applies to complaints concerning Products, Sales Contracts, Electronic Services, and any other issues related to the Seller or the operation of the Online Store.
A complaint may be submitted, for example:
In writing to: ul. Grabowa 14/15, 43‑178 Ornontowice
By email to: lociknivesandtools@gmail.com
Product returns related to a complaint may also be sent to the same physical address.
It is recommended (but not required) that the complaint description include:
Details and circumstances of the issue — especially the type of defect and the date it occurred.
The customer’s requested remedy — such as bringing the product into conformity with the contract, reducing the price, withdrawing from the contract, or another claim.
Contact details of the person submitting the complaint.
Providing this information helps speed up the complaint process, but omitting it does not invalidate the complaint.
If the customer’s contact details change during the complaint process, they must inform the Seller.
The customer may attach evidence related to the complaint (e.g., photos, documents, or the Product itself). The Seller may also request additional information or evidence if it helps resolve the complaint more efficiently.
The Seller will respond to the complaint promptly, no later than 14 calendar days from the date of receipt.
The legal basis for the Seller’s liability is defined by applicable Polish law, including the Civil Code, the Consumer Rights Act, and the Act on Electronic Services. Additional details regarding product conformity obligations are provided:
For physical goods purchased before 31 December 2022, liability is governed by the Civil Code (articles 556–576), covering defects under statutory warranty. For non‑consumer customers, warranty liability is excluded under Article 558 §1.
For physical goods (including those with digital elements) purchased from 1 January 2023, liability is governed by the Consumer Rights Act (articles 43a–43g), covering non‑conformity with the contract.
For digital content, digital services, or physical goods serving solely as carriers of digital content, liability is governed by the Consumer Rights Act (articles 43h–43q), applicable to purchases made from 1 January 2023 or delivered after that date.
Products may also be covered by a commercial guarantee, which is separate from statutory rights. A guarantee may be provided by the manufacturer or distributor. Guarantee terms, responsible entities, and conditions are specified in the guarantee documentation. The Seller emphasizes that statutory consumer rights always apply regardless of any guarantee.
For physical goods purchased before 31 December 2022, warranty rules follow the Civil Code (articles 556–576). Warranty liability is excluded for non‑consumer customers under Article 558 §1.
For physical goods purchased from 1 January 2023, liability follows the Consumer Rights Act (articles 43a–43g).
The consumer‑related provisions in sections 6.8.2 and 6.8.3 also apply to individuals conducting business activity, provided the contract is not professional in nature for that person — based on the scope of their business listed in the CEIDG registry.
Consumers may use mediation, arbitration, or other ADR methods. Information is available at the Polish Office of Competition and Consumer Protection (UOKiK). Contact details and examples of ADR options are provided.
Consumers may withdraw from a distance contract within 14 days without giving a reason.
Withdrawal may be submitted:
In writing to the store address
By email to lociknivesandtools@gmail.com
Returned goods should be sent to the store’s physical address.
The withdrawal period begins:
When the consumer receives the product
For multiple deliveries — when the last item is received
For digital or service contracts — on the day the contract is concluded
Upon withdrawal, the contract is considered void.
The seller must refund all payments within 14 days of receiving the withdrawal notice. Refunds may be withheld until the product is returned or proof of shipment is provided.
Consumers must return the product within 14 days of withdrawal.
Consumers are responsible for any decrease in product value resulting from improper use.
Rules for digital content withdrawal follow the Consumer Rights Act.
